Terms of Service
1. Who we are
CastCalc and the Casting Cost Audit are offered by BPLP Consulting, Barbara Plahuta s.p., Breg pri Borovnici 4A, 1353 Borovnica, Slovenia, Tax no. 58148698, not liable for VAT (Art. 94 ZDDV-1) ("we", "us"). Osturu and CastCalc are its brands. Contact: sales@osturu.com.
2. Business customers only
CastCalc is a business-to-business service for companies and their employees. By creating an account you confirm that you act for a business (the "Customer") and that you may accept these terms for it. Consumer protection rules for consumers, including the right of withdrawal, do not apply.
3. The service
CastCalc calculates estimated should-costs for castings from the inputs you enter and from market data that we update every month, and provides tools to check supplier quotes, prepare price negotiations and record results. The features of each plan are described on the pricing page.
Estimates, not offers. Should-costs, indices and assessments are estimates based on a cost model and assumptions. They do not guarantee that a supplier will accept a price and are not technical, legal or financial advice. You remain responsible for your purchasing decisions and for checking the inputs you enter.
4. Account and access
- Sign-up requires a company e-mail address, confirmed with a link we send you.
- Each login is personal. Keep your password confidential and tell us at once if you suspect misuse.
- Team plan: the account owner invites and removes users up to the number of seats of the plan and is responsible for the users of the team. Parts shared in a team are visible to all its users.
5. Trial, plans and payment
- New accounts get a 30-day trial with all features, free of charge and without a card; one trial per company. After the trial the account continues on the Free plan unless a paid plan is chosen.
- Paid plans (Professional, Team) are billed monthly or annually in advance. Card payments are processed by Stripe; Team billed annually can also be paid by invoice, within 15 days of the invoice date.
- Prices are net amounts. The seller is not liable for VAT (Art. 94 ZDDV-1), so no VAT is charged; EU business customers outside Slovenia account for any VAT under the reverse-charge rules of their country.
- Subscriptions renew automatically for the same period until cancelled. You can cancel at any time, in the billing portal or by e-mail; the cancellation takes effect at the end of the current billing period and you keep access until then.
- No refunds for started periods. Fees for a billing period that has started are not refunded, also when you cancel or stop using CastCalc during that period, unless the law requires a refund.
- We may change prices for future billing periods with at least 30 days' notice by e-mail; you can cancel before the new price applies.
- If a payment fails and is not made within 14 days of a reminder, we may move the account to the Free plan.
6. Casting Cost Audit and consulting hours
The scope, price and delivery date of a Casting Cost Audit are agreed in writing before we start. Consulting hours included in the Team plan are booked by e-mail or calendar invitation and expire at the end of each subscription year.
7. Your data
Your inputs, saved parts, quotes, price challenges and results ("Customer Data") belong to you. We use them only to provide the service, keep it secure and support you, as described in the Privacy Policy. We never share Customer Data with foundries or other customers. Where we process personal data on your behalf, the Data Processing Agreement applies. You can ask for an export of your Customer Data at any time.
8. Acceptable use
You may not share logins, resell or publish CastCalc data or results as a data service, copy or extract the price data or the cost model in bulk, test the security of the service without our written consent, or use it in a way that harms its operation or other users.
9. Intellectual property
The software, cost model, market data, texts and report layouts remain ours or our licensors'. You get a non-exclusive, non-transferable right to use CastCalc for your internal business during your subscription, and to use the reports you create for your own purchasing work, including sharing them with your suppliers.
10. Availability and changes
We aim for high availability but do not guarantee uninterrupted service; maintenance may cause short interruptions, announced in advance where possible. We may improve or change features. If a change materially reduces what a paid plan includes, you may cancel with effect from the change and we refund the unused part of a prepaid annual period.
11. Liability
We are liable without limitation for damage caused intentionally or by gross negligence and for injury to life, body or health. Otherwise our total liability is limited to the fees you paid for CastCalc in the 12 months before the event, and we are not liable for indirect damage, lost profit, or the outcome of negotiations or purchasing decisions based on CastCalc results.
12. Term and termination
The contract runs as long as the account exists. Either side may end a paid subscription at the end of a billing period. We may suspend or close an account for a serious breach of these terms. After an account is closed, its data is deleted as described in the Privacy Policy, except records we must keep by law.
13. Changes to these terms
We may update these terms. We announce material changes at least 30 days in advance by e-mail; if you do not agree, you may cancel before they apply.
14. Law and courts
The law of the Republic of Slovenia applies, excluding the UN Convention on Contracts for the International Sale of Goods. The courts in Ljubljana, Slovenia, have exclusive jurisdiction.
